The Realism of the Court of Justice  of the European Union in addressing the complex patterns of enterprises and work

Abstract

European integration has contributed to transforming the regulation of enterprises and labour into a transnational matter. Thus, the Court of Justice of the European Union case law offers a privileged standpoint on the legal responsiveness to existing challenges. In that regard, the globalization of supply chains along with the digital revolution, which constitutes striking examples of the complexification of organizations and production patterns, are the last expressions of questioning labour laws’ models and conceptions. The analysis of the Court’s case law, including that relating to fundamental freedoms, arguably displays a realistic approach, that is a pragmatic method, a willingness to construct legislation so as to endow EU Law its full effect, together with a specific care to its social context.
