The course is part of the degree program proposing to provide the tools to understand the legal framework within which the company, in particular the multinational operates today. First of all, we will look at the reasons that push companies to internationalize and / or delocalize production. Then we will address the impact of Direct Foreign Investments in the policies of governments and in the strategic choices of companies. Finally , we will focus on the problems that these trends pose to law, in particular labour law, and in the well-known phenomena of social and regulatory dumping.
The course analyses the tools developed by the international institutions to promote workers' rights in the global context as well as the interactions between international trade and social rights in the Gatt-Wto system. In the special part, which focuses essentially on the analysis of management from the labour law point of view, we will investigate the behaviour of multinationals in the global market, the regulating institutions of contractual labour relations with elements of internationality, the models of outsourcing and production delocalization (with reference to procurement contracts, subcontracting), backshoring practices with particular reference to the impact on labour markets. In addition, the tools prepared by the companies for an intensification of responsible consumption will be examined, with particular reference to corporate social responsibility (codes of conduct, social certification, etc.) and to sustainability.
Comprehension
1.1 Knowing the dynamics of companies in terms of internalization and the impact of labour regulations in outsourcing processes.
1.2. Knowing the structure, rules and functioning of the labour market on a global scale, the labour laws which apply in the international context, the regulatory bodies and the instruments of regulation.
1.3. Interpreting the evolution of international labour law.

2. Applying knowledge and comprehension
2.1.Knowing how to identify the rules applicable to employment relationships with elements of internationality and the responsibilities of companies in the case of violation of fundamental rights.
2.2.Knowing how to identify and then link the multilevel regulatory sources that insist on international labour law.
2.3. Applying the normative and case law within the reference context, highlighting the purposes and critical aspects of the regulatory sources.

3. Assessment skills
3.1. Interpreting the law.
3.2. Critically elaborating the regulatory sources with particular reference to the relationship between national and supranational dimension and multilevel case law.
3.3. Resolution of practical cases related to labour law litigation.

The learning will be verified with an oral exam on the main institutes of the subject and, possibly, on teamwork and/or written paper assigned during the course.
