BANKING LAW

The course is an interdisciplinary activity of the Bachelor's Degree in Economics and Business and at the same time suggested for those students of the Bachelor's Degree in Economics and Management/Business Administration who are interested in the Master's Degree in Economics and Finance or generally in banking and finance.
The course aims to offer a panoramic view of the banking activity, with special attention to banking contracts (with hints to smart contracts) and anti-money laundering, combating terrorism and usury discipline.
Some lessons will be devoted also to the discipline of paying systems and to the phenomenon of cryptocurrencies.

1. Knowledge and understanding
1.1 Knowledge of the various forms of the banking activity.
1.2 Knowledge of the general discipline of banking contracts, especially referred to transparency, anti-laundering and anti-usury.
1.3 Knowledge and analysis of the main banking contracts.

2. Applied skills of knowledge and understanding
2.1 Comprehension of the banking discipline on transparency, anti-laundering and anti-usury.
2.2 Capability of identification of the proper banking contract.
2.3 Comprehension of the discipline of each banking service.

3. Evaluation
3.1 Comprehension of the text of the law.
3.2 Capability of evaluation of the legal consequences of each banking contract.
3.3 Capability of balancing the different interests concerning contracts between bank and customer.

4. Communication skills
4.1 Proper reporting of the specific features of banking law.
4.2 Critical and dialogical interaction with the examiners during the examination.

Students are suggested to know the contents of the course of Business and Economic Law (or Commercial Law) II.

A second edition of this text is in order to be published in November 2019. The teacher will provide the pages of the new edition.

Additional learning material (such as doctrine articles, judgements, etc.) will be posted on Moodle platform.

Lectures will be integrated with some seminars provided by experts of banking law and by officers of credit institutions.

The final exam consists exclusively in an oral test in order to verify the knowledge and comprehension of the course contents, the proper reporting of them and the ability of consulting legal texts.
