The course, after having preliminarily introduced to the competitive scenarios within which the enterprises operate, with particular regard to the management of the relationships of job, it will stop itself on the deepened examination, with a practical orientation also, of the important juridical institutes, yes like interpreted from the jurisprudence and implemented from the collective bargaining, used in order to catch up the consequent objectives to the requirements of the enterprise and the workers. The course wants also to characterize itself for a pragmatic and casuistic approach, useful to students addressed to a dynamic and not traditional market of the job, like that one by now affirmed also in our country. In particular, focusing on the recent reforms of the Jobs Act.
The course, included in the EXPERIOR project of the Department of Management, provides a series of operational meetings, at the end and during the lessons.
Attendance and active participation in the educational activities proposed by the course and individual study will allow students to:
1. Knowledge and understanding
1.1. acquire the fundamental institutions of labor law.
2. Ability to apply knowledge and understanding
2.1 To know how to find one's way in today's complex labour market, both as a worker and as a manager of a business.
3. Judgment
3.2. as a worker, to be able to evaluate one's own set of rights and obligations; as an employer, to be able to evaluate the opportunities offered by the legal system in the management of the work factor and to be aware of the limits imposed by the same system.
This course assumes knowledge of private law.
Taking also into account that the students of the degree in Business Economics may have attended the teaching of Labor Law, the themes of the sources of labor and trade union law will be studied in depth; of the Workers' Statute and the profiles of trade union law and industrial relations, focusing attention and deepening the issues, including jurisprudential, of collective bargaining. As for the profiles of the employment relationship, the establishment of the relationship and the most practiced types of contracts, the forms of outsourcing of the company will be deepened, also with practical exercises and interventions by HR and trade union representatives, putting the student in a position to fully understand the legal dynamics underlying these phenomena (temporary work, company transfer, contracts and secondments).
A further and central theme in the "management of the company" will be that of the remuneration systems, increasingly linked to the economic performance of the company and the participation of workers as well as corporate welfare. Great attention will be given to the practical application of the matter by jurisprudence in order to make the concrete real dynamics of business life understood right now.
