INTERNATIONAL LAW

This course is part of the bachelor’s degree programme in International Trade and Tourism. It aims at providing a basic knowledge of International Law, outlining the main features of the international legal system and its relationship with the Italian legal system.

1. Knowledge and ability to understand the basics of Public International Law;
2. Knowledge and ability to solve the main problems of Public International Law;
3. Ability to understand a normative text and ability to develop an opinion on topics debated during the course;
4. Ability to write reports concerning cases seemingly discussed before the International Court of Justice or other dispute settlement bodies;
5. Ability to find and read the normative sources and case-law even through the main websites.

A basic knowledge of Private Law and Public Law is helpful.

1. The Historical Evolution of the International Community.
2. Subjects of International Law: the State; International Organisations; Insurgents; National Liberation Movements; NGOs and Transnational Corporations; the Individual in International Law.
3. The Sources of International Law: International Custom; General Principles of Law; Ius Cogens; Treaties; other sources, soft law.
4. Intra-State Application of International Law.
5. International Responsibility.
6. Settlement of International Disputes.

Students have to carefully read the following fundamental documents:
• Vienna Convention on the Law of Treaties;
• Draft Articles on Responsibility of States for Internationally Wrongful Acts;
• Charter of the United Nations;
• Statute of the International Court of Justice.

It is highly recommended to keep in mind the provisions of the Italian Constitution that are relevant to Public International Law.

For Erasmus Students there will be written exam lasting three hours with two essay questions and the possibility for the student to pass an oral exam (only for those who have successfully passed the written test; the mark obtained in the oral exam will average with that obtained in the written test). The exam will cover the entire program.

18-20/30: livello sufficiente. ll/la candidato/a raggiunge i risultati di apprendimento previsti;
21-23/30: livello pienamente sufficiente. ll/la candidato/a raggiunge i risultati di apprendimento previsti con una certa padronanza degli strumenti conoscitivi
24-26/30: livello buono. ll/la candidato/a raggiunge i risultati di apprendimento previsti con una notevole padronanza degli strumenti conoscitivi e autonomia di giudizio;
27-29/30: livello molto buono. ll/la candidato/a raggiunge i risultati di apprendimento previsti con una ottima padronanza degli strumenti conoscitivi e autonomia di giudizio;
30-30 e lode: livello eccellente. ll/la candidato/a raggiunge i risultati di apprendimento previsti con una eccellente padronanza degli strumenti conoscitivi dimostrando una conoscenza piena della materia.
