The course aims to promote the acquisition of fundamental knowledge of the legal aspects of the subject.
The course focuses on institutions charged with the protection, enhancement and promotion of cultural and landscape assets.
A case-based approach will be mainly used during the course, even through the presence of experts working for public or private institutions devoted to promote and preserve artistic and cultural heritage.
The discussion of the topics will follow a critical and problematic method, the expected result consists in the development of the students' interpretative and argumentative skills and their aptitude for legal reasoning.
No knowledge of legal concepts is formally required.
Basic notions of public and private law could be useful.
The course will focus on some essential questions: what is the relationship between power and culture? How is this relationship organised by law? In what relationship are public authorities and private in managing cultural activities?
- Introduction to public law
- Constitutional dimension of cultural heritage: art. 9 of the Italian Constitution
- The V Title of the Constitution and the separation of competences between State, Regions and local governments
- The Public Administration: constitutional principle and the Act on the administrative procedure (Act. n. 241/1990)
- Cultural heritage: identification and proclamation of cultural interest
- The system of cultural heritage and activities: public and private
- The cultura institutions
During the corse, experts will present the cultural institutions operating in Venice.

To add three chapters (I, II, III, 72 pp.) from M. Ainis, M. Fiorillo, L'ordinamento della cultura, Giuffrè, Milano, ultima edizione. These chapters will be provided on Moodle.

Students must verify the contents of the classes through the slides uploaded on Moodle.
Written examination consisting of two broad open questions, which will enable the students to demonstrate their understanding of the course's fundamental concepts and the development of critical and analytical skills. Each question will be rated out of 15.
Teacher reserves the right to organise an intermediate written test (not compulsory) in order to assess the ongoing acquisition of the subject.

Exam will be rated on 30 points, according to the following scale:
- 18-21: sufficient knowledge of the essential elements of the subject. Sufficient ability to give an oral presentation with appropriate terminology.
- 22-24: fair knowledge of the essential elements of the subject. Fair knowledge of the essential elements of the subject.
- 25-27: good knowledge of the essential elements of the subject. Good oral presentation skills with appropriate terminology.
- 28-29: excellent knowledge of the essential elements of the subject. Excellent oral presentation skills with appropriate terminology.
- 30: excellent knowledge of the essential elements of the subject. Excellent oral presentation skills with appropriate terminology.
- 30 Summa cum laude: Excellent knowledge of the essential elements of the subject. Excellent oral presentation skills with appropriate terminology. Deep skills of reflection.
Lectures supplemented by discussion in the classroom with reference to concrete cases. Intervention of external experts.

This subject deals with topics related to the macro-area "Human capital, health, education" and contributes to the achievement of one or more goals of U. N. Agenda for Sustainable Development
