Contribution of the course to the overall degree programme goals
The course will provide students with the fundamental knowledge of International, European and domestic legislation and legal issues related to transport and tourism contracts, their functions as regulatory tools of the tourism market and consumer protection. In this sense, the analysis will cover the impact on the tourism sector of digitalisation, as well as the emerging phenomena of the sharing economy and the role of digital platforms and OTA.
The purpose of the lessons is to encourage the acquisition of adequate technical and juridical language and the ability to find solutions in the complexity of the sources of law, in particular with respect to the law of contracts which characterise this specific system.
Expected learning outcomes
1.1 Understand the multilevel legal system which governs the tourism area.
1.2 Understand the legal institutions and contracts most used in tourism activities.
1.3 Understand the role of the studied legal institutions, how they govern the relationships between legal subjects and how to find the best solution to solve disputes in Business to Consumer contracts.
2. Applying knowledge and understanding
2.1 Ability to comprehend the legal system and the sources of law applicable to a certain situation.
2.2 Ability to find the legal provisions and contracts suitable for a certain situation regarding different economic actors of the tourism sector.
2.3 Once acquired the knowledge of the legal institutions, determine which one finds application to solve conflicts or regulate certain economic relationships.
3. Making judgements
3.1 Capacity to understand legal provisions.
3.2 Ability to identify, distinguish, relate different principles and legal provisions belonging to different sources of the multilevel system.
3.3 Ability to find the provisions or the institutions to solve or manage private relationships.
4. Communication skills
4.1 Proper reporting of the specific features of private law, by using appropriate language.
4.2 Ability to interact with tourism law issues.
4.3 Ability to develop critical opinions.

It is essential to study EU legal acts (regulations, directives), case-law by the Court of Justice of the European Union and other EU documents, easily available online.
Assessment methods
For attending students, supplementary in-person learning activities and group work will be organised during the teaching period (e.g. moot courts or workshops) on selected topics (e.g. unfair commercial practice in air transport, blockchain, etc.). Participation in these activities may contribute to the final grade (e.g. bonus points, possibility to choose to answer 2 out of 3 questions, etc.). However, students who choose not to participate will still have the opportunity to achieve the highest possible final grade.
Type of exam
The lecturer has a duty to ensure that the rules regarding the authenticity and originality of exam tests and papers are respected. Therefore, if there is suspicion of irregular conduct, an additional assessment may be conducted, which could differ from the original exam description.
Grading scale
- knowledge and understanding of the exam's questions (range 10 points);
- ability to analytically scrutinize the exam's questions (range 8 points)
- ability to identify and highlight connections between legal rules (range 6 points);
- linearity and logic of the written answers (range 6 points)
Teaching methods
During the course, the most relevant case law decisions will be examined and discussed.
For attending students, supplementary in-person learning activities and group work will be organised during the teaching period (e.g. moot courts or workshops) on selected topics (e.g. the right to be forgotten, blockchain, etc.).
