Private law is one of the basic educational activities in the degree programme in International Trade and Tourism. The course aims to provide students with essential information concerning the basic legal institutions of private law and basic legal concepts for understanding the legal regulation of individual economic relationships.
1. Knowledge and understanding:
- Knowledge of the private legal institutions;
- Knowledge of the multilevel legal system which governs today's private relationships;
- Understanding the role of private legal institutions and the way in which the rules of Private law govern private relationships.
2. Ability to apply knowledge and understanding:
- Ability to identify legal rules suitable to govern private conflicts or cooperation relationships.
3. Judgment:
- Being able to interpret legal provisions.
- Being able to identify, distinguish and relate different principles and legal provisions belonging to different sources of the multilevel system.
None prerequisite is required.
The modern legal systems. Sources of law. The structure of the rule of law. The interpretation of the law. Rights and duties. The subjects of law. Natural and legal persons. The legal goods. The obligations in general. Performance, breach, and contractual liability. Private property and possession. The private autonomy and the circulation of goods. The general rules on contract (formation, validity and invalidity, effectiveness and ineffectiveness, execution, breach). Consumer contracts. Civil liability and tort law.

It is recommended the study of the (Italian) Civil Code, including the Constitution, EU Treaties, and sectoral codes, such as:

The final test is divided into two parts. The first part consists of a test of 15 multiple-choice questions (20 min. max.) in order to attest a basic knowledge of the legal foundations of private law. The test is passed if the number of correct answers is 9/15 or more.
After the first part of the exam, there will be a second written test of 2 open-ended questions (duration: 1 hour) in which the student has to demonstrate knowledge of the topics covered in the course and the ability to explain them with legal language properties.
The tests will be held on the same day of the exam appeal, consecutively.
The pre-test does not contribute to the final assessment. See the section below for the evaluation of the second part of the exam.

A mark in the 18-22 range will be awarded in case of:
•⁠ ⁠sufficient knowledge of the institutes referred to in the open question;
•⁠ ⁠sufficient communication skills, especially in relation to the use of legal language;
•⁠ ⁠limited to sufficient ability to make independent judgments.

Marks in the 23-26 range will be awarded in the case of:
•⁠ ⁠fair knowledge of the institutions referred to in the open question;
•⁠ ⁠fair communication skills, especially in relation to the use of legal language;
•⁠ ⁠discrete ability to formulate autonomous judgments.

Marks in the 27 to 30 range will be awarded in case of:
•⁠ ⁠good to very good knowledge of the institutions referred to in the open question;
•⁠ ⁠good to very good communication skills, especially in relation to the use of legal language;
•⁠ ⁠good to very good ability to make independent judgments.

Honours will be awarded for excellent knowledge, expository skills and ability to make independent judgments.
The Course is structured in several frontal lessons and practical exercises.
